The following Conditions of Sale set out the conditions under which you (the Consumer) purchase products from us through our website [https://livingandlovinglife.com.au/] (Site). In this policy me, weus or our means LIVING AND LOVING LIFE [ABN: 96 612 682 997]. Please read these terms and conditions carefully. By making a purchase through the Site, you agree to these Conditions of Sale.

Payments: Payments can be made on the Site through options provided at checkout, including but not limited to Square and PayPal. Payments must be made and received in full, prior to products being dispatched. Payments are made in Australian Dollars and include GST (where applicable). 

Processing: Orders are processed and dispatched after payment has been received in full.

Cancelling or amending an order: Orders cannot be cancelled once payment has been made. If you need to amend an order in any way (ie. change of style/size etc.) after payment has been made, please contact me immediately through the Contact Me page or by sending an email to: dee@livingandlovinglife.com.au. We will endeavour to accommodate any requests. However, amendment requests may not be able to be accommodated due to stock availability. Also, depending on timing, your order might have already been dispatched and thus, be too late to make any amendments.

Shipping: Shipping is available to addresses within Australia and we cannot ship to any address outside of Australia. Orders are shipped through Australia Post at a flat shipping rate of $9.95. This will include tracking, which can be provided to you, the Consumer, upon request. We will do our best to ensure orders are dispatched within 3 business days after order payment has been cleared. Please note business days do not include Saturday, Sunday or NSW public holidays. We cannot guarantee the arrival timeframe of your delivery as this is subject to Australia Post’s delivery schedule.

Errors in shipping details: Please ensure that you provide the correct delivery address during the checkout process. Please contact us immediately through the Contact Me page or by sending an email to dee@livingandlovinglife.com.au if you believe any detail to be incorrect and we will endeavour to make any relevant changes to your shipping details prior to dispatch. However, depending on timing, this does not guarantee that your order has not already been dispatched. If items are returned to sender for any reason, you will be required to pay a redelivery fee of $14.95, prior to having the order re-sent.

Free shipping on purchases over $150: Free shipping applies automatically to orders over $150 in value. However, the use of a coupon code voids the ‘free shipping on purchases over $150’ promotion. If making a purchase over $150, you, as the Consumer, have a choice to accept the free shipping for orders over $150 (which should apply to your cart automatically), or use a particular coupon code instead.This cannot be changed once payment has been made.

Coupons: Coupon codes must be entered at the time of sale. Only one coupon code can be used per transaction. They cannot be applied once payment has been made. Please check your cart to ensure your coupon has been applied appropriately. Contact us by filling out the contact form on the Contact Me page prior to placing your order, if there are any issues with application of your coupon code (or send an email to dee@livingandlovinglife.com.au). Coupons entitling you a percentage discount off your order applies to any full priced items found on the Site. They do not apply to already discounted products (ie. Sale items).Coupons are not transferrable. They have no cash value and cannot be exchanged for cash. Coupons are valid until midnight AEST on the date published along with the particular coupon code. Coupons may have additional terms of usage (which may not be listed in these Conditions of Sale), but will be specified on any marketing or promotional material (including but not limited to, advertising flyers, emails, Facebook ads etc.) on which the coupon appears.

Returns: We do not accept return of goods for change of mind. We do accept returns on items if the product is faulty, in line with state law governing the sale of consumer goods: Our goods come with warranties and guarantees that cannot be excluded under the Australian Consumer Law (Consumer Guarantees). You are entitled to a replacement or refund for a major failure and for compensation for any other reasonable foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Please note that product wear and tear (including but not limited to pilling and frayed stitching of clothing and shoes, for example) does not constitute ‘major failure’ or ‘unacceptable quality’. Return requests must be made in a timely fashion (within 7 days of receipt of goods).

Returns procedure: If you deem the product to be faulty and warrant return, you are required to contact us by filling out the form on the Contact Me page (or send an email to: dee@livingandlovinglife.com.au) with the following information:

  • your name
  • email address
  • contact number
  • order number
  • item to be returned (including the style, colour and size, if relevant)
  • details outlining the reason for return

We will then provide you with an address of where to return your item. You will need to include your original invoice with your item (to verify purchase/ownership). Products must be packaged securely and need to be sent using a traceable method (such as through Registered Post or with a courier service). We do not accept responsibility for items lost in transit. Please note that this return shipping is at your cost (which MAY* be refunded). Products will then be inspected by us, to verify any product fault. If the item is deemed to be faulty, you will be entitled to a full refund of the purchase price of the item (*including return shipping costs up to the value of $9.95) or for a new item to be reshipped to you (at our cost). *A refund or replacement will NOT be provided if we deem the item as ‘without fault’. *For return postage to be included in the refund, you must include a copy of the return postage receipt.

Refunds: If you are entitled to a refund, we will do so in the same manor in which you paid. Please allow up to 10 business days for refunds to be processed. 

Incorrect sizing: We do not refund items for incorrect sizing choice. Regarding Attipas shoes, please refer to the Attipas Foot Sizing chart to make the correct choice when choosing a size for purchase. If you have made an incorrect sizing choice, you may return the item to us (at your cost). Products must be packaged securely and need to be sent using a traceable method (such as through Registered Post or with a courier service). We do not accept responsibility for items lost in transit. Please note that this return shipping is at your cost. Products must be returned in new condition and deemed as ‘re-sellable’ by us. Upon inspection of item and confirmation that item is deemed ‘acceptable for resale’, you will be provided with store credit, for the amount in which you paid for the item. Credit for returned items will be valid for 6 months after issue.

Out of stock items: All efforts are made to ensure products displayed on the Site are in stock. However, the circumstance might arise that a product is out of stock (for example, if another customer has an item you also have in your cart, but they process their order first, this may result in a product becoming out of stock). If this occurs, we will contact you as soon as possible using the contact details you have provided. We will offer you the choice of:

  • a full refund of the purchase price of the item (including delivery if there are no other items to be delivered)
  • the option to choose an alternate product or products from the Site totalling the same dollar value, or
  • for us to place your order on back-order if we are able to re-stock the specific item you ordered. If you choose this option, all items in your order will be dispatched at the same time, once your back-ordered item has arrived to us. We can give you an estimate of delivery time, but this is not guaranteed due to circumstances out of our control (eg. supplier dispatch turnaround and Australia Post/courier delivery time frames). Any delays do not warrant a claim for compensation from us to you.
Law: These Conditions of Sale are bound by NSW law and subject to the jurisdiction of the NSW Courts. If any conditions are deemed unenforceable by any relevant NSW law enforcement agencies, that particular condition will be void. However, the remaining conditions will remain in effect.

Updates: We reserve the right to amend and alter these Conditions of Sale at any time.
